Chapter 1 General Provisions
Article 1 (Purpose)
The purpose of these Terms and Conditions is to set forth the conditions, procedures, and rules for the use of the service "jamtory.com" provided by Jamtory Co., Ltd. (hereinafter referred to as the "Company") and other necessary matters.
Article 2 (Effectiveness and Amendment of Terms)
These Terms and Conditions become effective when posted on the service screen or notified to members by other means.
The Company may amend these Terms, and the amended Terms become effective in the same manner as set forth in the preceding paragraph.
Article 3 (Governing Law for Matters Not Specified)
Matters not specified in these Terms shall be governed by the provisions of the Framework Act on Telecommunications, the Telecommunications Business Act, and other related laws.
Article 4 (Definition of Terms)
The definitions of terms used in these Terms are as follows:
Member: A person who has entered into a service agreement with the Company
ID: A combination of letters or numbers selected by the member and approved by the Company to identify the member and use the service
Email: The member’s internet mail account
Password: A combination of letters and numbers set by the member to verify that the member corresponds to the assigned ID and to protect the member’s privacy
Administrator: A person designated by the Company for overall management and smooth operation of the service
Termination: Cancellation of the service agreement by the Company or the member after service activation
Chapter 2 Membership Registration and Service Use
Article 1 (Formation of Service Agreement)
The service agreement is established upon the Company’s acceptance of the user’s application and the user’s consent to the Terms.
Applicants wishing to become members and use the service must provide personal information requested by the Company.
The Company may refuse to accept service applications in the following cases:
If the applicant is under the age of 14
If the name provided is not the real name
If another person's identity is used
If false information is provided in the application
If the application is intended to disrupt public order or good morals
Other cases where the application does not meet the Company’s requirements
Article 2 (Change of Contract Information)
Members must immediately update their information online if any changes occur after registration.
Chapter 3 Service Use
Article 1 (Service Hours)
Service use is generally available 24 hours a day, year-round, unless there are special technical or business reasons. However, this does not apply during regular maintenance or website upgrades.
The Company may divide the service into separate areas and set different availability times for each area, which will be notified in advance.
Article 2 (Member ID, Email, and Password Management Obligations)
Members are responsible for managing their ID, email, and password. The Company is not liable for any consequences resulting from negligent management or misuse by the member.
If a member’s ID, email, or password is used improperly, the member must notify the Company immediately.
Members must comply with these Terms and related laws.
Article 3 (Provision of Information)
The Company may provide members with information deemed necessary during service use via email, telephone, postal mail, or other methods.
Article 4 (Member Posts and Copyright)
Posts refer to texts, photos, files, links, and other content posted by members during service use.
Members are responsible for any damages or issues arising from their posts, and the "Mall" is not liable.
The Company may, without prior consent, take actions such as removing, modifying, suspending, or refusing to register posts if they:
Defame or insult other members or third parties
Violate public order or good morals
Encourage illegal copying or hacking
Infringe on third-party copyrights
Contain advertisements for profit
Are objectively linked to criminal acts
Infringe on other users’ or third parties’ rights
Contain political or religious content deemed inappropriate for the service
Violate posting rules or are inconsistent with the bulletin board’s nature
Violate applicable laws
Copyright of posts belongs to the posting member. However, the "Mall" may use the posts without compensation for operational, display, transmission, distribution, or promotional purposes in accordance with fair practices defined by copyright law.
If the Company wishes to use posts in ways not covered above, prior consent must be obtained via phone, fax, or email.
Posts retained or reposted by others, combined with third-party posts, or registered on public boards are not deleted even if the member terminates the service agreement.
Article 5 (Suspension of Service)
The Company may suspend service provision in the following cases:
Unavoidable maintenance or construction of service facilities
If a telecommunication service provider suspends services according to the Telecommunications Business Act
The Company may limit or suspend all or part of the service in cases such as national emergencies, power outages, facility failures, or sudden spikes in service usage.
Chapter 4 Liability
Article 1 (Obligations of the Company)
The Company shall, unless exceptional circumstances exist, allow members to use services on the requested start date.
The Company has the obligation to continuously and stably provide services according to these Terms.
The Company shall not disclose or distribute members’ personal information to third parties without consent, except when requested by government authorities, for criminal investigations, by the Information and Communication Ethics Committee, or according to other legal procedures.
Article 2 (Obligations of Members)
Members shall not:
Illegally use another member’s email
Copy, publish, broadcast, or provide service information to third parties without prior consent
Infringe third-party rights such as copyrights
Distribute content violating public order or morals
Engage in acts objectively linked to criminal activity
Engage in acts violating applicable laws
Members must comply with these Terms, service guides, and notices.
Members must follow usage restrictions posted or notified by the Company.
Members may not conduct business activities using the service without prior consent, and the Company is not responsible for any outcomes from such activities.
Chapter 5 Termination and Use Restriction
Article 1 (Termination and Service Restriction)
Members wishing to terminate the service agreement must apply online themselves.
The Company may terminate the agreement or restrict service without prior notice if a member:
Uses another person’s ID, email, or password
Intentionally disrupts service operation
Provides a false name
Intentionally distributes content violating public order or morals
Uses the service to harm national or social interests
Defames or disadvantages others
Violates any other conditions set by the Company
Article 2 (Procedure for Restriction and Reinstatement)
The Company shall notify the user or their representative by email or other means of the reason, time, and details of restriction, unless urgent suspension is required.
The user may file an objection to the restriction notice.
The Company may temporarily defer the restriction during verification and notify the user of the result.
If the cause of restriction is resolved during the restricted period, the Company shall immediately lift the restriction.
Chapter 6 Miscellaneous
Article 1 (Compensation for Damages)
The Company is not liable for any damages incurred by members from the use of free services.
The Company is liable for damages related to paid services caused by the Company’s fault in accordance with applicable laws.
Anyone who publicly defames another person via information and communication networks may be punished by imprisonment up to 3 years, detention, or a fine up to KRW 20,000,000. <Article 70(1) of the Act on Promotion of Information and Communications Network Utilization and Information Protection> (Punishable regardless of falsehood)
Anyone who publicly spreads false information to defame another person via information and communication networks may be punished by imprisonment up to 7 years, disqualification up to 10 years, or a fine up to KRW 50,000,000. <Article 70(1) of the Act on Promotion of Information and Communications Network Utilization and Information Protection>
Article 2 (Disclaimer)
The Company is exempt from liability when services cannot be provided due to natural disasters or force majeure.
The Company is not responsible for service disruptions caused by member’s fault.
The Company is not responsible for expected profits, losses, or damages arising from use of the service or data obtained from it.
The Company is not responsible for the reliability or accuracy of member-posted information, data, or facts.
Article 3 (Jurisdiction)
In case of disputes arising from service use, the court having jurisdiction over the Company’s headquarters shall have jurisdiction.
Addendum
(Revision Date) These Terms shall be effective from November 1, 2021.
